As chief judicial officer, the Chief Justice chairs sessions of the Court en banc, assigns cases, presides over deliberations, and often issues the Court’s opinion when designated. The Chief Justice also carries important administrative duties: supervising lower courts, managing judicial budgets and personnel, and representing the judiciary in official functions. By longstanding practice the Chief Justice may administer the oath of office to the President.

The Chief Justice is appointed by the President from a shortlist provided by the Judicial and Bar Council, subject to the constitutionally prescribed qualifications. Appointees are typically experienced jurists or senior members of the bar who meet age and practice requirements. There is no fixed term: justices serve until mandatory retirement, and they can be removed only by impeachment or other constitutional processes.

The Chief Justice has sometimes played a high-profile role in national crises or in clarifying constitutional boundaries between branches of government. For example, the current Chief Justice, Alexander Gesmundo, was appointed in 2021 by President Rodrigo Duterte.

The Chief Justice’s decisions and administrative choices influence the rule of law, access to justice, and public trust in courts.
